Welcome to SecKonnect. These Terms and Conditions ("Terms") govern your access to and use of the SecKonnect website, hardware devices, software, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using SecKonnect Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

SecKonnect provides a hardware-accelerated Zero Trust Network Access (ZTNA) edge device along with a cloud-based admin panel and supporting software. The Services include:

  • The SecKonnect hardware edge device and any firmware contained therein.
  • The SecKonnect admin and monitoring panel, accessed via a web browser.
  • Documentation, support, and updates provided in connection with the Services.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract to use the Services. The Services are intended for use by enterprises and authorized representatives.

4. Accounts & Provisioning

To use the Services in production, you will be issued admin credentials and one or more SecKonnect devices. You are responsible for:

  • Maintaining the confidentiality of any admin panel credentials.
  • All activity that occurs under your account or with devices issued to you.
  • Notifying SecKonnect immediately of any suspected unauthorized access or device loss.

5. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract keys from any SecKonnect device or firmware.
  • Use the Services for unlawful purposes or in violation of any applicable regulation.
  • Attempt to gain unauthorized access to systems, networks, or data not authorized by your provisioning policies.
  • Resell, sublicense, or transfer SecKonnect devices or services without prior written consent.
  • Interfere with the Services' availability or with other customers' use of the Services.

6. Intellectual Property

All intellectual property rights in the Services — including the SecKonnect hardware design, firmware, software, brand, logos, documentation, and the website — are owned by SecKonnect or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. No other rights are granted.

7. Orders, Pricing & Payment

Pricing for SecKonnect Services is provided via written quotation or executed order form. Unless otherwise stated, all fees are exclusive of taxes. Invoices are payable within thirty (30) days of receipt. Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.

8. Hardware Warranty

SecKonnect warrants that hardware devices will be free from material defects in workmanship for a period of one (1) year from the date of delivery. The sole remedy for breach of this warranty is repair or replacement at SecKonnect's option. The warranty does not cover damage caused by misuse, unauthorized modification, or external factors such as power surges or extreme conditions.

9. Service Level Commitments

SecKonnect targets the following service level objectives for production-tier customers:

  • Admin Panel Availability: 99.9% monthly uptime, excluding scheduled maintenance windows.
  • Initial Response Time: Critical (P1) — 1 hour; High (P2) — 4 hours; Normal (P3) — 1 business day.
  • Replacement Hardware: Verified defects dispatched within 5 business days.

SLA terms are formalized in the Master Services Agreement provided with each subscription.

10. Customer Data

Customer data — including session logs, device identity, and access policy configurations — is processed in accordance with our Privacy Policy. SecKonnect does not store traffic content. You retain all rights to your data; we act as a processor on your behalf for the purposes outlined in our agreement.

11. Confidentiality

Each party may receive non-public information from the other ("Confidential Information"). Each party agrees to use the other's Confidential Information solely to perform its obligations under these Terms and to protect such information with at least the same degree of care it uses for its own confidential information.

12. Termination

Either party may terminate the Services for material breach upon thirty (30) days written notice if the breach is not cured within that period. Upon termination, your right to use the Services ends, devices must be returned (or destroyed) per the order form, and admin panel access is revoked. Provisions intended to survive termination — including confidentiality, intellectual property, and limitations of liability — will survive.

13. Disclaimers

EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." SECKONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SECKONNECT DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THEY WILL PREVENT ALL UNAUTHORIZED ACCESS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECKONNECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. SECKONNECT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES PAID BY YOU TO SECKONNECT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless SecKonnect, its affiliates, officers, and employees from any claims, damages, or expenses arising out of your use of the Services in violation of these Terms or applicable law.

16. Export Controls

The SecKonnect device contains cryptographic technology and is subject to applicable export control laws. You agree not to export, re-export, or transfer the device or related technology to any party or jurisdiction restricted under such laws.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved by the courts located in Bengaluru, Karnataka, unless otherwise required by applicable law. The parties agree to attempt good-faith resolution before initiating formal proceedings.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the website or email at least thirty (30) days before they take effect. Continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
