The agreement that governs your use of the SecKonnect website, devices, and services.
Welcome to SecKonnect. These Terms and Conditions ("Terms") govern your access to and use of the SecKonnect website, endpoint agent software, admin panel, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
By using SecKonnect Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
SecKonnect provides a software-defined Zero Trust Network Access (ZTNA) platform delivered as a lightweight endpoint agent and a cloud-based admin panel. The Services include:
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Services. The Services are intended for use by enterprises and authorized representatives.
To use the Services, you will be issued admin credentials and you will enroll user endpoints into your SecKonnect tenant. You are responsible for:

All intellectual property rights in the Services — including the SecKonnect agent software, admin panel, brand, logos, documentation, and the website — are owned by SecKonnect or its licensors. You are granted a limited, non-exclusive, non-transferable license to install and use the agent and access the admin panel in accordance with these Terms. No other rights are granted.
Pricing for SecKonnect Services is provided via written quotation or executed order form on a per-user, per-month subscription basis. Unless otherwise stated, all fees are exclusive of taxes. Invoices are payable within thirty (30) days of receipt. Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.
SecKonnect warrants that during a paid subscription term, the agent software will materially conform to the Documentation. SecKonnect provides routine updates, security patches, and feature releases over a secure, signed update channel at no additional charge. The sole remedy for breach of this warranty is correction of the non-conformity or, at SecKonnect's discretion, refund of pre-paid fees for the affected period. The warranty does not extend to issues caused by unauthorized modification, use outside the published System Requirements, or third-party software conflicts.
SecKonnect targets the following service level objectives for production-tier customers:

Customer data — including session logs, device identity, and access policy configurations — is processed in accordance with our Privacy Policy. SecKonnect does not store traffic content. You retain all rights to your data; we act as a processor on your behalf for the purposes outlined in our agreement.
Each party may receive non-public information from the other ("Confidential Information"). Each party agrees to use the other's Confidential Information solely to perform its obligations under these Terms and to protect such information with at least the same degree of care it uses for its own confidential information.
Either party may terminate the Services for material breach upon thirty (30) days written notice if the breach is not cured within that period. Upon termination, your right to use the Services ends, you must uninstall the agent from all enrolled endpoints, and admin panel access is revoked. Provisions intended to survive termination — including confidentiality, intellectual property, and limitations of liability — will survive.
EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." SECKONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SECKONNECT DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THEY WILL PREVENT ALL UNAUTHORIZED ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECKONNECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. SECKONNECT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES PAID BY YOU TO SECKONNECT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless SecKonnect, its affiliates, officers, and employees from any claims, damages, or expenses arising out of your use of the Services in violation of these Terms or applicable law.
The SecKonnect agent software contains cryptographic technology and is subject to applicable export control laws. You agree not to export, re-export, or transfer the software or related technology to any party or jurisdiction restricted under such laws.
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved by the courts located in Bengaluru, Karnataka, unless otherwise required by applicable law. The parties agree to attempt good-faith resolution before initiating formal proceedings.
We may update these Terms from time to time. Material changes will be communicated via the website or email at least thirty (30) days before they take effect. Continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
